Art. 1 Scope of application

1.2 This document (Terms of Use) governs the terms of use of this Site by the user, that is to say the natural person who interacts with the Site (User).

1.3 The Site Owner may modify the Terms of Use at any time. The changes will be valid and effective as soon as they are published online.

1.4 Access to the Site requires acceptance of the Terms of Use.

1.5 The User is invited to regularly access the Terms of Use to view the most up-to-date version of this document.

1.6 The entirety of any element of the Site is the property of the Site Owner or third parties. Without the specific written consent of the Site Owner, it is forbidden to reproduce, in whole or in part and through any process, distribute, publish, transmit, modify or sell all or part of the content of the Site.

1.7 Under no circumstances can the Site Owner be held responsible to you or to third parties for any indirect, incidental, special or consequential damage. This includes, but is not limited to, any loss of income or other indirect loss resulting from the use of the Site or the inability to use it. The Site Owner cannot guarantee or affirm: (i) that the Site is free from viruses or programs that may damage data; (ii) that the information contained in the Site is accurate, complete and updated.

1.8 This document fully governs the relationship between you and the Site Owner. In any case, the rights and obligations provided for by applicable law are without prejudice to the rights and obligations provided for by applicable law.

Art. 2 Intellectual Property

2.1 Any material on the Site is covered by copyright pursuant to law 633/1941. Therefore, unless otherwise agreed in writing with the Site Owner or unless otherwise indicated on the Site, the User is prohibited from copying, disseminating, communicating, transferring, modifying, in whole or in part, for any reason and in any form, the material on the Site. The prohibition of reproduction also extends to the layout of the Site, to the graphics, to the design and to the way in which the web pages are presented.

2.2 The User is prohibited from using domain names similar to those of the Site or that may cause confusion among users.

2.3 The prohibition set out in Article 2.1 refers in particular to:

• eBooks or any other downloadable material.

2.4 The trademarks and distinctive signs on the Site are the property of the Site Owner or third parties. Therefore, the User is prohibited from using, reproducing, modifying, in any way and for any purpose (even non-economic), these brands and distinctive signs, without the written consent of the Site Owner or the third party owner of the trademark or distinctive sign.

Art. 3 Use of the Site and User Responsibility

3.1 The User may interact with the Site and its functions only for lawful purposes, without causing harm to the Site Owner or to third parties.

3.2 The User is personally responsible for the use of the Site, as well as for any information, message or document transmitted to the Site Owner or to third parties through the Site.

3.3 The User is prohibited from circumventing, in any way, any form of protection on the Site.

3.4 The Site Owner reserves the right to suspend (even indefinitely) or close the account if it believes that the User has used the Site in violation of applicable legislation from time to time or that it has caused or attempted to cause damage to the Site Owner or to third parties.

3.5 There is no discussion forum on the Site. Therefore, the user who intends to share material can send it to the Site Owner. The Site Owner reserves the right to publish the material on the Site and/or to share it with any third party. The User waives any right and/or claim on the material sent to the Site Owner.

3.6 On the Site there are links to external sites. The Site Owner is not responsible for the content of these sites and for any damage or prejudice that the User may have suffered from interacting with them.

Art. 4 Exclusion of liability of the Site Owner

4.1 The Site Owner declines all responsibility for any possible damage resulting from inaccessibility to the Site, even temporary, and for damage caused by viruses, error/missing information or data, cancellation of content, any network problem or attributable to the network provider. The Site Owner declines any responsibility for any damage or prejudice that the User may have suffered from any material downloaded through the Site.

4.2 The Site Owner has taken every standard precaution to publish truthful information on the Site. That said, the Site Owner does not provide any guarantee about the accuracy of this information. The User is invited to inform the Site Owner of the presence of any incorrect or missing information.

Art. 5 Processing of personal data. Managing cookies

5.1 Any personal information of the User is treated in accordance with Regulation 679/2016 (GDPR) and the indications of the Privacy Guarantor.

5.2 The user can view the way personal data is processed by accessing the privacy policy published on the Site.

5.3 The way cookies are processed can be viewed by accessing the cookie policy published on the Site.

Art. 6 Applicable Law. Competent court

6.1 The law applicable to these Terms of Use is Italian law.

6.2 For any dispute deriving from the application and/or interpretation of these Terms of Use, the Court where the Site Owner is based is exclusively competent. If the User acts as a consumer pursuant to art. 3 of the Consumer Code, the competent court is the one where the User resides or resides.

Art. 7 Reviews

7.1 In accordance with the provisions of Legislative Decree No. 26 of March 7, 2023, the Site allows the publication of reviews by users. The Site Owner does not guarantee that the published reviews always come from consumers who have actually purchased or used the product or service. Among the reviews published on the Site, some may have been solicited, for example by sending a discount coupon. In this case, this circumstance is duly indicated on the requested review. In addition, reviews may be published that originate from sponsorships or a relationship with a professional (e.g. influencer); even in this circumstance, due notice is given on the relevant review.
